1. Platform Identification
GoMatt is a digital platform accessible through www.gomattours.com that enables users ("Travelers") to discover, book, and participate in experiences offered by independent third parties ("Hosts").
GoMatt acts exclusively as a technological intermediary between Travelers and Hosts.
Unless expressly stated otherwise, GoMatt:
• Does not organize experiences.
• Does not provide tourism services.
• Does not act as a tour operator.
• Does not own the assets or means used to deliver the experiences.
• Is not a party to the contract concluded between Travelers and Hosts.
2. Acceptance of Terms
By accessing, registering for, or using the platform, users fully accept these Terms and Conditions.
If a user does not agree with these terms, the user must refrain from using the platform.
3. Nature of the Platform
GoMatt provides technological tools to:
• Publish experiences.
• Manage bookings.
• Facilitate communications.
• Process payments through third-party providers.
• Manage incidents and mediation procedures.
The contract relating to each experience is concluded exclusively between the Traveler and the corresponding Host.
GoMatt does not act as the seller, supplier, or provider of the experiences published on the platform.
4. User Registration
Users must:
• Provide accurate and up-to-date information.
• Maintain the confidentiality of their credentials.
• Use the platform lawfully.
GoMatt may suspend or terminate accounts where there is evidence of fraud, misuse, or breach of these Terms.
5. Hosts
Hosts are solely responsible for:
• Creating and maintaining their listings.
• Determining the price of their experiences.
• Obtaining any necessary permits, licenses, or authorizations.
• Complying with applicable laws and regulations.
• Properly delivering the services offered.
The Host warrants that all necessary rights exist to market and provide the published experience.
6. Bookings
When a Traveler makes a booking:
• The Traveler submits a booking request.
• The Host agrees to provide the experience.
• A direct contractual relationship is established between both parties.
GoMatt does not become a party to such contractual relationship.
7. Payments
Payments made through the platform are processed by specialized third-party payment providers, including Stripe and its related services.
Funds may be subject to verification procedures, temporary holds, risk reviews, or compliance requirements established by such providers.
GoMatt does not hold or safeguard users' funds in its own bank accounts except where required by applicable law.
8. GoMatt Commission
For the use of the platform, GoMatt may charge commissions or service fees.
Such amounts constitute consideration for the technological intermediation services provided by GoMatt and are independent of the price established by the Host for the experience.
9. Cancellations and Modifications
Cancellation policies shall be established by each Host and displayed before booking.
GoMatt may provide tools to manage:
• Cancellations.
• Date change requests.
• Refunds.
• Claims and complaints.
The availability of such tools does not imply that GoMatt assumes responsibility for the performance of any experience.
10. Incidents and Mediation
Where a dispute arises between a Traveler and a Host, GoMatt may offer a voluntary mediation procedure.
Participation in such procedure shall be optional for both parties.
Any proposal issued by GoMatt shall be conciliatory in nature and shall not constitute a judicial or arbitral decision.
GoMatt does not guarantee that the parties will reach an agreement.
11. Limitation of Liability
To the maximum extent permitted by law:
GoMatt does not guarantee:
• The quality of experiences.
• The accuracy of descriptions provided by Hosts.
• The conduct of users or Hosts.
• The uninterrupted availability of the platform.
GoMatt shall not be liable for damages arising from:
• Experience cancellations.
• Contractual breaches by Hosts.
• Inaccurate information published by third parties.
• Injuries, accidents, or losses suffered during an experience.
Responsibility for delivering the experience rests solely with the Host.
12. Insurance and Risks
Travelers acknowledge that certain activities may involve inherent risks.
Each participant is responsible for assessing their own physical condition and suitability to participate in any experience.
GoMatt recommends that Hosts maintain adequate insurance coverage for the activities offered.
13. Intellectual Property
All content on the platform, including:
• The GoMatt brand.
• Design.
• Software.
• Databases.
• Proprietary text and images.
belongs to GoMatt or its licensors and is protected by applicable intellectual property laws.
14. Suspension and Termination
GoMatt may suspend or terminate user access where:
• Fraudulent activities are detected.
• These Terms are breached.
• Compliance with legal or regulatory obligations so requires.
15. Data Protection
Personal data shall be processed in accordance with the Privacy Policy published on the platform.
16. Amendments
GoMatt may amend these Terms for legal, operational, or commercial reasons.
Any amendments will be notified to users through reasonable means.
17. Governing Law and Jurisdiction
These Terms shall be governed by the laws of Spain.
Unless mandatory law provides otherwise, any dispute shall be submitted to the competent courts and tribunals of Spain.
